Purchases

In order to purchase the goods displayed on Les Vêtements Orizon G.P.’s (hereinafter “Orizon”) website, including gift cards, you will be required, at certain times, to enter certain information, including but not limited to your credit card information and your billing information. By providing this information, you guarantee that it is both accurate and up to date. Making a purchase confirms that you agree to pay all charges incurred by you or persons you authorize, including, but not limited to, via your account, credit card or PayPal account in connection with the order placed. Orizon reserves the right to refuse an order at its sole discretion, for any reason.

Orders placed on the Orizon website are subject to a process comparing the information provided by the buyer on the website with the information about the buyer provided by its financial institution. In the event of discrepancy, your order may be delayed until the information can be corrected.

Currency, Payment Methods and Applicable Taxes

All prices listed on the Orizon website are in Canadian dollars.

The following payment methods are accepted: PayPal and credit cards (Visa Credit and Debit, Mastercard Credit and Debit, American Express, Discover and Union Pay).

Sales taxes are based on the delivery address. Note that these differ from one province to another in Canada. They will be adjusted accordingly for your order.

Items Availability

Orizon will make every effort to provide you with the best possible information regarding the availability of the products on this website. However, some products on this website may not be available. Thus, if an item is not available, you can make a reservation with a deposit of twenty-five percent (25%) payable immediately and the balance of seventy-five percent (75%) will be payable before delivery when the item is available again.

Changes

The prices indicated on this website are subject to change without notice. Discounts on selected items from the catalogue or otherwise identified are in effect while supplies last. Orizon reserves the right to correct any errors in the prices indicated on this website or in partner stores. Orizon will use its best efforts to ensure that any price errors are brought to your attention as quickly as possible, through this website or in-store. Orizon may, at its sole discretion, refuse any order or purchase in the event of such error.

Returns

With the exception of gift cards and items specifically identified as "final sale" or deemed to be a final sale, any item purchased in an Orizon partner store or on this website may be returned for refund or exchange (subject to the following terms and conditions) within thirty (30) days of the date of purchase. Any sale of an item sold with a discount of forty percent (40%) or more is deemed to be a final sale.

Any return of an item will be subject to the returned item being in good condition and in its original packaging without having been worn, washed, or used and accompanied by a proof of purchase and the original labels.

Returns of items purchased on this website may be made by mail only. Please note that no return, exchange, or refund of items, if applicable, purchased online may be made at a partner store.

The return package must identify your online account number appearing on your receipt. After completing the available form by clicking on the link below, a pre-printed shipping label will be issued to affix on the return package.

You will not have any fee to pay at the post office if you use the pre-printed label. However, we will deduct an amount of fifteen dollars ($15.00) plus taxes from your refund to cover the shipping fees.

Returns of items purchased from any Orizon partner store must be made at the store indicated on the receipt. Please note that no return, exchange, or refund of an item, if applicable, purchased in a partner store may be made by mail.

Impossibility to Deliver

Orizon is not responsible for any orders that cannot be delivered or received because the address you provided is not accurate. Please ensure that the address of the recipient is correct and contact Customer Service if you believe the recipient has not received its order.

Delivery Costs and Delivery Destination

Free shipping is available on orders over one hundred and ninety dollars ($190.00) before taxes. A delivery fee of fifteen dollars ($15.00) plus taxes is payable for orders under one hundred and ninety dollars ($190.00) before taxes.

Orizon offers delivery almost everywhere in Canada, except in areas that have a postal code with an air omnibus service. For clarity purpose, regions that have a postal code with an air omnibus service are served by an Air Omnibus Service office, where all mail must be received or air-shipped more than six (6) months per year.

Risk of Loss

All items purchased on this website are delivered by a third-party delivery company under a delivery contract, as mentioned on your order. However, Orizon assumes the risk of loss and damage of the items until the moment they are delivered to you. In order to honour this policy, Orizon reserves the right to require a signature upon reception of the delivery or any other proof of delivery that Orizon deems satisfactory. If no one can receive the delivery, a delivery notice may be left, and the package will be held at the shipping establishment indicated on the notice in accordance with the third party delivery company’s policies.

Order Cancellation

It will not be possible for you to cancel an order made on the Orizon website, except for the reasons specifically prescribed by applicable laws and regulations.

Delivery Time

The items in stock are indicated on the Orizon website at the time of your order. It takes between seven (7) and ten (10) working days for delivery, unless otherwise indicated by Orizon at the time of your order. If an item is not in stock, you can express your interest in purchasing this item by following the procedure provided for this purpose on this website. By placing an order with Orizon, you agree to the delivery time indicated on your order. As soon as your order is shipped, you will receive an email with a link to the third-party delivery company website that will allow you to track your package.

Guarantees

Other than the warranties granted by the manufacturers of the items sold on this website, which are subject to the terms and conditions contained therein, as well as the warranties prescribed by law, Orizon makes no representation of any kind and provides no warranty, implied or explicit, regarding the merchantability, quality, or fitness for a particular purpose of an item or the accuracy of the information provided regarding an item.

Invalidity of the Terms and Conditions of Use

If any provision of these Terms and Conditions is invalid or unenforceable, the other terms and conditions shall remain valid and enforceable under their terms.

It is the intention of the parties that the provisions of these Terms and Conditions be enforced to the fullest extent permitted by applicable laws. Therefore, the parties agree that if provisions are deemed to be unenforceable, they will be deemed modified to the extent necessary to make them enforceable and in a manner that is as close as possible to the intentions of the parties to these Terms and Conditions.

Waiver of Terms and Conditions of Use

Failure to comply with any provision herein does not constitute a waiver of the right to enforce the provision in the future. These Terms and Conditions shall inure to the benefit of and be binding upon the parties, their successors, and assigns.

Force Majeure

If Orizon’s performance of any of the obligations stated herein or those stated in your order confirmation is delayed due to force majeure or any other reason beyond Orizon’s control, the date of performance will be delayed for the duration of the delay.
